Contractors, Delivery Vehicles and Visitors
The shared access area referred to on this website provides access to the adjoining properties, garages and parking areas.
Contractors, delivery vehicles and visitors are kindly requested not to leave vehicles within the shared access areas whilst undertaking works or for extended periods.
If you are visiting either property and are unsure where to park, please speak to the resident you are visiting, who will be happy to advise on suitable arrangements.
The purpose of this request is simply to help maintain practical vehicular and pedestrian access for all residents and users of the adjoining properties.
Introduction
The information shown on this website is taken from the original transfer documents and title plans held by HM Land Registry.
The title plans and transfer document extracts referenced on this website are derived from HM Land Registry records, which are publicly available.
When the properties were originally purchased, the transfer documents established the boundaries, access arrangements, rights and obligations relating to each property. These rights and obligations continue to apply to subsequent owners.
When purchasing a property, the transfer documents define not only the land being purchased, but also any associated rights and obligations relating to access, boundaries and shared areas.
Shared Access Area
The shared access areas shown on the plans form part of an agreed access arrangement serving the adjoining properties, garages and parking areas. The arrangement enables each property to retain practical vehicular and pedestrian access in the manner originally intended by the transfer documents.
Property Title Plans
The adjoining properties are registered under separate HM Land Registry title numbers. The plans below identify the respective property boundaries and the shared access areas referred to within the transfer documents.

First Schedule – Clause 4
Note – This provision is reciprocal and appears in identical form within the transfer documents relating to both properties.
The right in common with the transferor and all others having a like right to pass and repass for all purposes connected with the property hereby transferred with or without vehicles over and along the accessway and garage forecourts coloured black on the said plan annexed hereto on payment of a proportionate part of the expenses of repairing and maintaining the same.
Plain English Explanation
This clause contains two related provisions. The first concerns rights of access over the shared access area. The second concerns responsibility for contributing towards the cost of maintaining that shared access area.
This clause grants the owners and occupiers of both properties the right to pass and repass, with or without vehicles, over the shared access area shown in black on the title plans.
In simple terms, the shared access area exists so that both properties can continue to enjoy practical vehicular and pedestrian access to their garages, parking areas and associated parts of their properties in the manner originally intended by the transfer documents.
These rights are attached to the properties themselves and continue to apply to subsequent owners and occupiers.
The clause also provides that the owners contribute a fair proportion of the cost of maintaining the shared access area.
